1. General Provisions

These Terms of Service ("Terms") govern the use of the SofiHR recruitment system ("System") and define the rights and obligations of users.

By using the System, you accept these Terms and agree to follow them.

2. Definitions
  • SofiHR Platform

    Web application for recruitment, providing services to HR clients

  • HR Client

    Organization using the platform for recruitment

  • Candidate

    User undergoing interviews or testing on the platform

  • User

    Individual using the platform (candidate, HR manager)

3. System Functionality

The System provides the following capabilities:

  • Creating and Managing Vacancies

    For HR managers

  • Applying for Vacancies

    For candidates via public links

  • Conducting Interviews

    Video and audio interviews with recording

  • Candidate Testing

    Assessment of skills and competencies

  • Comparing Candidates

    AI analysis and ranking

4. Acceptable Use Policy

When using the System, you agree not to:

  • Violate Applicable Laws

    Including federal, state, and local laws of the United States

  • Provide False or Misleading Information

    All information must be accurate and truthful

  • Discriminate or Harass

    Violation of equal employment opportunity laws, harassment, or discriminatory practices

  • Compromise System Security

    Hacking, unauthorized access, denial of service attacks, or malware distribution

  • Violate Privacy Rights

    Unauthorized disclosure or misuse of personal information

  • Use Automated Tools

    Bots, scrapers, or automated systems without express written permission

Anti-Discrimination Notice: This System must be used in compliance with all applicable employment laws, including Title VII of the Civil Rights Act, the Americans with Disabilities Act (ADA), and the Age Discrimination in Employment Act (ADEA). Discriminatory use of this System is strictly prohibited.

5. User Obligations

Users are obliged to:

    Current and truthful data about yourself

  • Maintain Confidentiality

    Not disclose information about other candidates

  • Use the System for Its Intended Purpose

    Only for recruitment purposes

  • Comply with Technical Requirements

    Stable internet connection, modern browser

6. Disclaimer of Warranties and Limitation of Liability

Disclaimer: THE SYSTEM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

  • No Guarantee of Availability

    System may be unavailable due to maintenance, updates, or technical issues

  • No Guarantee of Accuracy

    AI-generated content and analysis may contain errors or inaccuracies

  • No Guarantee of Employment

    System is a tool to assist in recruitment; hiring decisions are solely at the discretion of employers

Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Important: The System is not responsible for employment decisions made by HR managers or employers. All hiring, rejection, and other employment-related decisions are made solely by the employer and are their responsibility.

7. Intellectual Property

All rights to the System belong to the developers:

    Trademarks and branding

  • Algorithms and Technologies

    Patented solutions

Users do not have the right to copy, modify, or distribute System elements without permission.

8. Privacy and Data Protection

The System is committed to protecting your privacy and personal information in accordance with applicable U.S. data protection laws and regulations.

  • Data Encryption

    Industry-standard encryption during transmission and storage

  • Access Control

    Strict access controls and authentication measures

  • Activity Logging

    Comprehensive logging of all data operations

  • Data Retention

    Video and audio recordings retained for no more than 60 days

Video and audio interview recordings are used exclusively for interview and assessment purposes and are stored for no more than 60 calendar days from the interview completion date. For complete information, please see our Privacy Policy.

9. Changes to Terms of Service

We reserve the right to change these Terms:

    Option to stop using the system

10. Termination of Use

Use of the System may be terminated:

  • At User's Initiative

    Withdrawal of consent for data processing

  • Upon Terms Violation

    Automatic access termination

  • For Technical Reasons

    System update or closure

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms shall be resolved through good faith negotiations. If the parties cannot resolve the dispute within thirty (30) days, either party may pursue legal remedies in accordance with applicable law.

You agree that any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the federal or state courts located in Delaware, and you consent to the personal jurisdiction of such courts.
